Five more entities have been added to the Uyghur Forced Labor Prevention Act (UFLPA) Entity List. Products from these five companies will be prohibited from entry into the US unless the importer can provide clear and convincing evidence that the goods were not produced by or contain inputs made with forced labor. UFLPA, signed into law in December of 2021, requires that Customs & Border Protection (CBP) apply a rebuttable presumption that goods from the Xinjiang Uyghur Autonomous Regions (XUAR) are produced with forced labor. This includes any goods grown, mined, or manufactured wholly or in part in the XUAR.
The new additions are:
- Xinjiang Habahe Ashele Copper Co., Ltd., a mining company located in the XUAR. The company is accused of working with the government to recruit, transport, or harbor members of persecuted groups in violation of UFPLA.
- Kashgar Construction Engineering (Group) Co., Ltd., a manufacturer of structural components and materials for construction, is also accused of working with the government in labor activities that violate UFPLA.
- Century Sunshine Group Holdings, Ltd., a Hong Kong-based manufacturer of magnesium fertilizer and magnesium alloy products. The US asserts that this company sources material, especially magnesium, from the XUAR.
- Rare Earth Magnesium Technology Group Holdings, Ltd., another Hong Kong-based manufacturer of magnesium alloy products believed to source material from the XUAR.
- Xinjiang Tengxiang Magnesium Products Co., Ltd., based in Hani, Xinjiang, China, manufactures magnesium and magnesium alloy products. The US has reasonable cause to believe this company receives Uyghurs or members of other persecuted groups in violation of UFPLA forced labor restrictions. In addition, they are accused of sourcing materials used in the production of magnesium and of operating a magnesium production facility in the XUAR.
These additions bring the total number of listed entities to 73.
