Over the past week, CV International has received numerous calls and emails from customers seeking clarification regarding the timing, eligibility, and process for potential IEEPA tariff refunds. We understand the uncertainty surrounding this matter and recognize the frustration it has created for importers. At this time, however, definitive guidance on the refund process has not yet been provided.
On March 2, the Department of Justice submitted a filing with the Court of Appeals for the Federal Circuit (CAFC) in response to V.O.S.—one of the two original plaintiffs in the IEEPA case—regarding its request to expedite returning the matter to the Court of International Trade (CIT). V.O.S. requested expedited consideration so that proceedings could begin toward a final resolution and potential refunds.
In its response, the U.S. government argued that there was no urgency, stating that:
These statements suggest that the U.S. government does not intend to accelerate the process.
However, the CAFC responded promptly and, later that same afternoon, granted V.O.S.’s motion. The case will now return to the Court of International Trade to begin proceedings to determine how refunds should be issued to V.O.S. This determination could potentially have broader implications for similarly affected importers.
